1. Agreement to Terms
By accessing or using FMG SCOUT ("the Service"), provided by Federal Media Group LLC ("we," "us," or "the Company"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is available at federalmediagroup.com and related subdomains.
2. Description of Service
FMG SCOUT is a subscription-based business development intelligence platform for government contractors. The Service monitors publicly available federal procurement data sources (including SAM.gov and USASpending.gov), analyzes opportunities using artificial intelligence, and delivers daily intelligence briefings via email and a web dashboard.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription and Billing
The Service is offered on a monthly subscription basis. Pricing is as listed on our website at the time of purchase. All fees are charged in advance and are non-refundable except as required by law. We use Stripe to process payments. Your subscription will automatically renew each month unless canceled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.
5. Free Trial
New accounts receive a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue accessing the Service. We reserve the right to modify or discontinue trial offers at any time.
6. Acceptable Use
You agree not to: (a) resell, redistribute, or sublicense the Service or its content without our written consent; (b) use the Service for any unlawful purpose; (c) attempt to reverse-engineer, decompile, or extract source code from the Service; (d) use automated scripts to access the Service beyond normal usage; (e) interfere with or disrupt the Service or its infrastructure.
7. Data and Content
The Service aggregates and analyzes publicly available federal procurement data. We do not guarantee the accuracy, completeness, or timeliness of any data or analysis provided. AI-generated content is provided for informational purposes only and should not be relied upon as the sole basis for business decisions. You retain ownership of any configuration data you provide (e.g., NAICS codes, keywords, competitor lists).
8. Intellectual Property
The Service, including its design, code, features, and branding, is owned by Federal Media Group LLC and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEDERAL MEDIA GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and governing law survive termination.
12. Changes to Terms
We may update these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Virginia.
